This End User License Agreement (“Agreement”) is between you and S&S Leap, Inc. and governs use of the Leap app made available through the Apple App Store. By using our website, located at http://leapapp.co (“Website”), our mobile app Leap, and/or other services we provide (collectively, “Leap”), you are accepting the practices set forth in this Agreement and the Privacy Policy. By installing the Leap App, you agree to be bound by this Agreement and understand that there is no tolerance for objectionable content. If you do not agree with the terms and conditions of this Agreement, you are not entitled to use Leap.

In order to ensure Leap provides the best experience possible for everyone, we strongly enforce a no tolerance policy for objectionable content. If you see inappropriate content, please use the “Report” icon found at the top right corner each user’s profile.

1. Parties

This Agreement is between you and Leap only, and not Apple, Inc. (“Apple”). Notwithstanding the foregoing, you acknowledge that Apple and its subsidiaries are third party beneficiaries of this Agreement and Apple has the right to enforce this Agreement against you. Leap, not Apple, is solely responsible for Leap and its content.


2. Limited License

Leap grants you a limited, non-exclusive, non-transferable, revocable license to use Leap for your personal, non-commercial purposes. You may only use Leap on Apple devices that you own or control and as permitted by the App Store Terms of Service.


3. Age Restrictions

By using Leap, you represent and warrant that (a) you are 18 years of age or older and you agree to be bound by this Agreement; and (b) your use of Leap does not violate any applicable law or regulation. Your access to Leap may be terminated without warning if Leap believes, in its sole discretion, that you are under the age of 18 years.


4. Reporting of Violations

You will promptly report to Leap any violation of the Agreement by others, including but not limited to, Registered Users.  


5. Content Posted by You on the Service

Leap reserves the right, but has no obligation, to monitor the information or material you submit or post to Leap. Leap will have the right to remove any such information or material that in its sole opinion violates, or may violate, any applicable law or either the letter or spirit of this Agreement or upon the request of any third party.

Without limiting the foregoing, the following is a partial list of the kind of Objectionable Content that is prohibited in Leap. You may not post, upload, display or otherwise make available Content that:

7. Warranty

Leap disclaims all warranties about Leap to the fullest extent permitted by law. Leap provides the services on an “As Is” and “As Available” basis and grants no warranty of any kind.


8. Maintenance and Support

Leap does provide minimal maintenance or support for it but not to the extent that any maintenance or support is required by applicable law, Leap, not Apple, shall be obligated to furnish any such maintenance or support.


9. Limitation of Liability

a. Incidental Damages and Aggregate Liability. In no event will Leap be liable for any incidental, special, consequential or indirect damages arising out of or relating to the use or inability to use the services, including, without limitation, damages for loss or corruption of data or programs, service interruptions and procurement of substitute services, even if Leap knows or has been advised of the possibility of damages.


b. No Liability for non-Leap Actions. To the maximum extent permitted by applicable law, in no event will Leap be liable for any damages whatsoever, whether direct, indirect, general, special, compensatory, consequential, and/or incidental, arising out of or relating to the conduct of you or anyone else in connection with the services, including without limitation, bodily injury, emotional distress, and/or any other damages resulting from communications or meetings with other registered users of the services. This includes any claims, losses or damages arising from the conduct of users who have registered under false pretenses or who attempt to defraud or harm you.


c. Information Verification. Leap and its contractors may use various ways of verifying information that users have provided. However, none of those ways are perfect, and you agree that Leap and its contractors will have no liability to you arising from any incorrectly verified information.

Privacy Policy

This privacy policy (“Privacy Policy”) describes the information collected by S&S Leap, Inc. (“we,” “us,” or “our”), how that information may be used, with whom it may be shared, and your choices about such uses and disclosures. By using our website, located at http://leapapp.co (“Website”), our mobile app Leap, and/or other services we provide (collectively, “Leap”), you are accepting the practices set forth in this Privacy Policy. If you do not agree with this policy, then you must not access or use Leap. Information We Collect and How We Collect It

Information collected automatically: When you use Leap, we automatically collect and store (in the Leap DateABase) certain information about your computer or mobile device and your activities. This information may include:

  1. Mobile Device ID. This is your mobile device's unique ID number (e.g., IMEI).

  1. If you're using our app, we use mobile device IDs to recognize you. We do this to store your preferences and track your use of our app.

  1. Geographic Location. Your computer's or mobile device's geographic location when you register for Leap and when you sign up for a date.

  1. Device Information/Specifications. Technical information about your computer or mobile device (e.g., type of device, web browser or operating system, IP address) to analyze trends, administer the site, prevent fraud, render graphics, track visitor movement in the aggregate, and gather broad demographic information.

  1. Length and Extent of Usage. How long you used Leap and which services and features you used.

  1. Cookies. We use “cookies” to keep track of some types of information while you are visiting Leap or using our services. “Cookies” are very small files placed on your computer, and they allow us to count the number of visitors to our site and distinguish repeat visitors from new visitors. They also allow us to save user preferences and track user trends. We rely on cookies for Leap's operation; therefore if your browser is set to reject all cookies, Leap may not function properly. Users who refuse cookies assume all responsibility for any resulting loss of functionality with respect to Leap.

  1. Web Beacons. “Web beacons” (also known as “clear gifs” and “pixel tags”) are small transparent graphic images that are often used in conjunction with cookies in order to further personalize Leap for our users and to collect a limited set of information about our visitors. We may also use web beacons in email communications in order to understand the behavior of our customers, such as whether an email has been opened or acted upon.

  1. Information you choose to provide. We may collect information that can identify you such as your name and email address ("personal information") and other information that does not identify you. We may collect this information through a website or a mobile application. By using the Service, you are authorizing us to gather, parse and retain data in the DateABase, related to the provision of the Service.

  1. In order to register as a user with Leap, you will be asked to sign in using your Facebook login. If you do so, you authorize us to access certain Facebook account information, such as your public Facebook profile (consistent with your privacy settings in Facebook), your email address, interests, likes, gender, birthday, education history, relationship interests, current city, photos, personal description, friend list, and information about and photos of your Facebook friends who might be common Facebook friends with other Leap users. You will also be asked to allow Leap to collect your location and calendar information from your device when you download or use the Service. In addition, we may collect and store any personal information you provide while using our Service or in some other manner, in the DateABase. This may include identifying information, such as your name, address, email address and telephone number, and, if you transact business with us, financial information. You may also provide us photos, a personal description and information about your gender and preferences for recommendations, such as search distance, age range and gender. If you chat with other Leap users, you provide us the content of your chats, and if you contact us with a customer service or other inquiry, you provide us with the content of that communication.

Push Notifications. By registering with Leap and allowing push notifications, you hereby authorize us to send push notifications to your mobile phone to facilitate your engagement with the app.

Online Survey Data. We may periodically conduct voluntary user surveys. We encourage our users to participate in such surveys because they inform us with respect to what we can improve about our product and service.  We do not link the survey responses to your name or email address, and all responses are anonymous.

How we use the information

Pursuant to the terms of this Privacy Policy, we may use the information we collect from you for the following purposes:

  1. facilitate matches with other Leap users;

  1. manage your account and provide you with customer support;

  1. communicate with you about Leap and related offers, promotions, news, upcoming events, and other information we think will be of interest to you;

  1. perform research and analysis about your use of, or interest in, our or others’ products, services, or content;

  1. monitor and analyze trends, usage and activities;

  1. website or mobile application analytics;

  1. investigate and prevent fraud and other illegal activities; and

  1. provide, maintain, and improve Leap and any associated products and services.

Sharing Your Information

When you register as a user of Leap, your Leap profile will be viewable by other users of the Service. Other users will be able to view any information you have provided to us directly or through Facebook.

We do not share your personal information with others except as indicated in this Privacy Policy.

We may share personal information with:

Service Providers. We may share your information with our third-party service providers that support various aspects of our business operations (e.g., analytics providers, security and technology providers, and payment processors) only for the purpose of providing Leap services.

Legal Disclosures and Business Transfers. We may disclose any information without notice or consent from you: (a) in response to a legal request, such as a subpoena, court order, or government demand; (b) to investigate or report illegal activity; or (c) to enforce our rights or defend claims. We may also transfer your information to another company in connection with a merger, corporate restructuring, sale of any or all of our assets, or in the event of bankruptcy.

Aggregate Data. We may share aggregated, non-personal information with third parties, including advisors and investors, for the purpose of conducting general business analysis. Leap will not sell your personal data to advertisers.

Updating or Removing Account Information

You may review or update your profile as you wish, by logging into your Leap account and navigating to the “Settings” page. You may also close your account at any time by visiting the "Settings" page for your account. If you close your account, we will retain certain information associated with your account for analytical purposes and recordkeeping integrity, as well as to prevent fraud, take actions we deem necessary to protect the integrity of our Service or our users, or take other actions otherwise permitted by law. In addition, if certain information has already been provided to third parties as described in this Privacy Policy, retention of that information will be subject to those third parties' policies.

Third Party Sites

Leap may contain links to other websites. If you choose to click on a third party link, you will be directed to that third party's website. The fact that we link to a website is not an endorsement, authorization or representation of our affiliation with that third party, nor is it an endorsement of their privacy or information security policies or practices. We do not exercise control over third party websites. These other websites may place their own cookies or other files on your computer, collect data or solicit personal information from you. Other websites follow different rules regarding the use or disclosure of the personal information you submit to them. We encourage you to read the privacy policies or statements of the other websites you visit.

Information you provide while Using Our Service

Leap provides areas where you can post information about yourself and others. We cannot control who reads your posting or what other users may do with the information you voluntarily post, so we encourage you to exercise discretion and caution with respect to your personal information.

Children’s privacy

We do not target or allow persons under 18 years of age to use Leap, and we do not knowingly collect information from persons under the age of 13. If you are a parent or legal guardian who discovers that your child has provided us with information without your consent, you may contact us at privacy@leapapp.co, and we will promptly delete such information from our files.

Protecting Your Personal Information

We endeavor to safeguard personal information to ensure that information is kept private. However, please be aware that unauthorized entry or use, hardware or software failure, the inherent insecurity of the Internet and other factors, may compromise the security of your personal information at any time. We do not promise, and you should not expect, that your personal information, chats, or other communications will always remain secure. Users should also take care with how they handle and disclose their personal information and should avoid sending personal information through insecure email.

Using Leap from outside the United States

Leap is intended only for users within the United States. Accordingly, this Privacy Policy is intended to cover the collection of information by our Website and mobile devices from residents of the United States. As a result, United States federal and state governments, courts, or law enforcement or regulatory agencies may be able to obtain disclosure of your information through laws applicable in the United States. If you are using Leap from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States where our servers are located and our central database is operated. By using Leap, you understand and agree that your information may be transferred to our facilities and those third parties with whom we share it as described in this Privacy Policy.

Changes to this Privacy Policy

We may update this Privacy Policy from time to time at our sole discretion. When we post changes to this Privacy Policy, we will revise the "last updated" date at the top of this Privacy Policy. We recommend that you check our Website from time to time to inform yourself of any changes in this Privacy Policy or any of our other policies.
